SCOTUS: Noel Canning oral argument expanded to 90 minutes

Only the most important cases are given 90 minutes. The importance of NLRB v. Noel Canning goes way beyond the immediate question of whether the President's appointments of NLRB Members were lawful under the constitution. This case will have an effect on all presidential appointments that require approval by the Senate.

So the US Supreme Court's decision to expand the time available for oral argument from the usual one hour to 90 minutes is significant.

  • The NLRB will be allowed 45 minutes.
  • Noel Canning will be allowed 30 minutes.
  • Republican leader Senator Mitch McConnell will be allowed 15 minutes. McConnell and 44 other Republican senators filed an amicus brief arguing that the appointments in this case were unconstitutional.
